Terms of Use

These Terms of Use ("Terms") govern your access to and use of Warbairy, including the mobile application, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

If you use the iOS version of the app, your use of the licensed application is also subject to Apple's Standard Licensed Application End User License Agreement, as applicable.

Eligibility

The Services are intended only for individuals who are at least 18 years old. By using the Services, you represent and warrant that you are at least 18 years old and legally capable of entering into these Terms.

The Services

Warbairy is a personal closet management and outfit recommendation service. The Services may allow you to:

• Upload images of clothing, outfits, and inspiration or preference images.
• Organize and catalog wardrobe items.
• Create, save, and review outfits and combinations.
• Receive labels, tags, recommendations, and other AI-assisted outputs based on your uploaded content, preferences, and profile information.

Some functionality may use third-party artificial intelligence or machine-learning services, including Anthropic models accessed through AWS Bedrock, to help analyze images and generate labels or recommendations.

Accounts

You may need to create an account to access some or all of the Services. You agree to provide accurate, current, and complete information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify Cymric Inc. at support@warbairy.ai if you believe your account has been compromised.

User Content

You may upload, submit, store, or otherwise provide content through the Services, including clothing photos, outfit photos, inspiration images, notes, preferences, profile information, and feedback (collectively, "User Content").

You retain ownership of your User Content. However, you grant Cymric Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, and display User Content solely as necessary to:

• Operate and provide the Services;
• Display User Content you choose to share to the people you share it with — other users for a public community post, or the participants of a conversation for a message;
• Maintain and improve product functionality;
• Detect, prevent, and address security or technical issues; and
• Comply with legal obligations.

This license ends when your User Content is deleted from the Services, except to the extent retention is reasonably necessary for backup, security, legal compliance, or deletion-processing purposes.

You represent and warrant that:

• You have all rights, permissions, and authority necessary to provide the User Content.
• Your User Content does not violate any law or infringe any third-party rights.
• If your User Content includes another person, you have any permission required to upload and use that image or information.

Zero Tolerance for Objectionable Content and Abusive Behavior

There is zero tolerance for objectionable content or abusive users on Warbairy. This applies to every part of the Services where you can share content or communicate with other people, including community posts, images, captions, comments, hashtags, location tags, display names, profile photos, and direct and group messages.

Objectionable content includes, without limitation, content that is:

• Sexually explicit, pornographic, or sexually suggestive involving minors in any way;
• Hateful, discriminatory, or demeaning toward a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic;
• Harassing, bullying, threatening, or intended to intimidate or humiliate another person;
• Violent, graphic, or that promotes or glorifies violence, self-harm, suicide, or eating disorders;
• Unlawful, or that promotes illegal goods, services, or activity;
• Spam, fraudulent, deceptive, or impersonating another person or entity.

Reporting and blocking. Every post, message, and user in the Services can be reported from within the app, and any user can be blocked. Blocking a user immediately removes their content from your feed and prevents them from messaging you or sending you a friend request.

Our commitment. Cymric Inc. reviews reports of objectionable content and acts on them within 24 hours. Where content is found to violate these Terms, Cymric Inc. will remove the offending content and may suspend or permanently terminate the account of the user who provided it, without notice and at Cymric Inc.'s sole discretion. Content that receives multiple reports may be automatically hidden from other users pending that review.

Automated screening. Content submitted to the community areas of the Services is automatically screened before publication, and content identified as objectionable may be declined or removed. Automated screening supplements, and does not replace, the reporting and review process described above.

By using the Services, you agree to these standards and acknowledge that violating them may result in immediate removal of your content and termination of your account.

What is private and what is shared

Most of what you put into the Services is private to your account — your closet items, outfits, try-on results, body and appearance information, and your conversations with the in-app AI stylist. These are visible only to you, except where disclosure is necessary to service providers acting on Cymric Inc.'s behalf or as otherwise described in the Privacy Policy.

Some features are, by their nature, visible to other people. You choose whether to use them:

• Community posts. A post you publish publicly — including its images, title, description, hashtags, and any location you tag — is visible to other users of the Services, and can be surfaced in feeds, in search, and to people browsing nearby posts. You may instead publish a post privately, in which case it is visible only to you.
• Closet items and outfits you add to a post. Your closet and your generated outfits are private by default. If you choose to include one in a community post, that item's image becomes visible to everyone who can see the post — but only the images you selected, and only for as long as the post includes them. You decide what goes into each post, and you can edit a post to add or remove images, change its text, or switch it to private, or delete the post entirely, at any time. Removing an item from your closet also removes it from any post that referenced it.
• Your public profile. Your handle, display name, and profile photo are visible to other users, including on your posts and in chat.
• Direct and group messages. Messages and any attachments you send are visible to the other people in that conversation. Chat is not anonymous and is not with strangers: you can only message people you have added as a friend, found by their exact handle, and who have accepted your request.

Content you make visible to others may be seen, saved, or shared onward by them. Deleting a post removes it from the Services, but Cymric Inc. cannot recall copies other people have already made. Consider this before posting anything you would not want seen widely.

Profile and appearance-related information

The Services may allow you to provide profile attributes relevant to personalization, such as selected body type, face type, style preferences, and, if enabled in the future, optional body measurements such as chest, waist, hips, inseam, or related sizing information. You are responsible for the accuracy of any such information you choose to provide.

AI-assisted features and outputs

The Services may provide labels, categorizations, recommendations, and other outputs generated or assisted by artificial intelligence ("AI Output"). AI Output may be inaccurate, incomplete, inconsistent, or not suitable for your preferences, body, fit, or situation.

You are responsible for reviewing AI Output before relying on it. AI Output is provided for general informational and convenience purposes only and is not professional, medical, legal, or other regulated advice.

Acceptable Use

You agree not to:

• Use the Services in violation of any applicable law.
• Upload unlawful, infringing, harassing, defamatory, hateful, sexually explicit, or otherwise objectionable content.
• Upload content you do not have the right to use.
• Attempt to reverse engineer, copy, scrape, disrupt, overload, or interfere with the Services.
• Use the Services to develop, train, benchmark, or support a competing AI model, dataset, or service where prohibited by applicable law or third-party provider terms.
• Circumvent technical restrictions, security controls, or access controls.

Third-Party Services

The Services may rely on third-party providers, including cloud hosting, analytics, authentication, and AI-processing providers. Some AI-related functionality may use Anthropic models through AWS Bedrock.

AWS states that Amazon Bedrock does not use prompts and completions to train models and that model providers do not have access to Amazon Bedrock prompts and completions in the Bedrock deployment architecture described by AWS. Anthropic's Bedrock commercial terms also state that Anthropic may not train models on customer content from the Bedrock services and that Anthropic receives usage data from AWS excluding customer content.

Intellectual Property

The Services, including the software, design, branding, text, graphics, interfaces, and related intellectual property, are owned by Cymric Inc. or its licensors and are protected by applicable intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred to you.

Suspension and Termination

Cymric Inc. may suspend or terminate your access to the Services if you violate these Terms, create legal or security risk, or misuse the Services.

Accounts that post objectionable content or engage in abusive behavior toward other users are subject to immediate removal of the offending content and suspension or permanent termination of the account, without prior notice. See "Zero Tolerance for Objectionable Content and Abusive Behavior" above.

You may stop using the Services at any time. You may also request deletion of your account as described in the Privacy Policy.

Disclaimers

The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Cymric Inc. does not guarantee that the Services will be uninterrupted, secure, error-free, or that any AI Output or recommendation will be accurate, complete, or suitable for your needs.

Limitation of Liability

To the fullest extent permitted by law, Cymric Inc. and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the Services.

To the fullest extent permitted by law, the total liability of Cymric Inc. for any claim arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to Cymric Inc. for the Services in the 12 months before the event giving rise to the claim, or (b) US$50. If the Services are free, this cap is intended to provide a reasonable allocation of risk.

Changes to the Terms

Cymric Inc. may update these Terms from time to time. If material changes are made, Cymric Inc. will post the updated Terms and update the "Last updated" date above. Additional notice may be provided where required by law.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where otherwise required by applicable law.
